Proposed Changes to Fla. R. Civ. P. 1.202 (Conferral Prior to Filing Motions)
The November 17, 2025 Florida Bar News has published proposed changes to Rules of Civil Procedure 1.202 (Conferral prior to filing motions), 1.410 (Subpoena), 1.442 (Proposals for Settlement), 1.490 (Magistrates), 1.620 (Extraordinary Remedies), 1.914(c) (Affidavit of Claimant in Response to Notice to Appear), 1.924 (Affidavit of Diligent Search and Inquiry), 1.944(b) (Mortgage Foreclosures), 1.977 (Fact Information Sheet) and 1.918 (Satisfaction of Judgment).
With regard to Rule 1.202, the Civil Procedure Rules Committee has suggested “3 new motions that would be exempted from the conferral requirement.
The amendments would include motions for leave to amend a pleading to assert a claim for punitive damages, motions to seek attorney’s fees and 57.105 motions.
According to the article, “Interested parties have until December 19, 2025, to submit comments electonically to Co-Chairs of the Civil Procedure Rules Committee.
